Rep. Robert Garcia, a California Democrat running for reelection, called for Brazilian Sen. Flávio Bolsonaro to be deported from the United States and demanded information about U.S. officials’ alleged role in his departure from Brazil. Garcia sent a letter to the State Department on Monday, Nov. 2, saying Bolsonaro should be returned to Brazil “immediately” to face justice.

In the letter to Secretary of State Marco Rubio, Garcia accused President Donald Trump of using Immigration and Customs Enforcement to “terrorize children and working people trying to support their families and communities,” while allowing Jair Bolsonaro’s son into the country. Flávio Bolsonaro is the subject of investigations in Brazil.

“If the president says he does not want criminals entering the United States, why allow Mr. Bolsonaro to enter?” Garcia wrote. He added that the senator “should be sent back to Brazil immediately to answer to justice.”

Garcia also requested records of communications about the senator’s trip among the White House, the State Department, the Department of Homeland Security, Trump adviser Jason Miller and Argentine officials. He asked the administration to explain the legal basis for granting visas to Flávio Bolsonaro and his family.

The letter also seeks documents concerning support for the Brazilian senator’s election campaign from the Rockbridge Network, a conservative group linked to U.S. Vice President J.D. Vance. Garcia’s request joins other documents sent to the State Department concerning Bolsonaro’s move to the United States.

Bolsonaro left Brazil on Oct. 27, two days after losing the 2026 election to Luiz Inácio Lula da Silva. He and his family crossed into Argentina before traveling to the United States on a private flight. The departure came after Brazil’s Supreme Federal Court ordered his passports seized and barred him from leaving the country. The order followed a Federal Police assessment that he might leave Brazil amid investigations into alleged corruption, money laundering and foreign-exchange evasion.
